How do I know if I have a Personal Injury Claim?

When should I contact a personal injury attorney?

The sooner you contact an attorney the better. If you have been injured be assured that the at-fault persons insurance company is going to try and contact you and ask for a statement as soon as possible. How much do you charge?

What are my rights?

You have the right to make an injury claim or file a lawsuit against the person, persons or entity that caused your injury. In Illinois, under most circumstances, a lawsuit must be filed within two years from the date of the injury. If the suit is filed after this deadline you will not be able to recover. In order to prevailyou have to prove that the defendant was negligent, and that the negligence was a cause of you being injured. If you prove these necessary elements you have the right to recover money damages such as reimbursement of economic damages such as medical expenses or lost income and non-economic damages such as pain and suffering and emotional distress.

What is my case worth?

As an injury victim you are entitled to full and fair compensation. Full and fair compensation means that you are entitled to a recovery that will “make you whole”. To make one whole means to return you to the way you were before you were injured. Since no injury victims will ever be the same after their injury as they were before the concept of full and fair compensation can be difficult to determine. No two cases or injuries are the same. A personal injury attorney will help to consider all of the elements of a case and determine value.

There are many factors that go into determining value such as:

Economic Damages: You are entitled to be fully reimbursed for economic damages that you have incurred. These damages are often objective hard numbers: Lost Income: if your injury causes you to miss work you should be reimbursed in full for the income lost while unable to work. If your injury prevents you form being able to work in the future you should be compensated for the present value of your income you will lose in the future.

Medical bills and costs: If you incur medical expenses or additional expenses due to your injuries you should be compensated in full for these expenses. If you require medical care in the future or special assistance then you should be compensated for all future medical care.

Noneconomic Damages: You are entitled to be fully and fairly compensated for damages that cannot be fixed simply by reimbursement of income or medical bills. These damages are subjective and not easily ascertainable. Noneconomic damages include your pain and suffering, your emotional distress, the loss of being able to engage in activities that bring you joy and pleasure.

Comparative Fault: Injury victims don’t often consider their own involvement in causing their own injuries, but be sure that juries and insurance companies will consider your fault when determining what your case is worth. If you are partially at fault for causing your injuries then that will reduce the value of your case.

Insurance Limits: In most personal injury claims the amount of available insurance typically sets the limit for the amount you are able to recover. An insurance company will only pay the limit maximum limit of the policy and nothing more. To collect beyond the available insurance is often a fruitless endeavor because most people don’t have enough money to pay a judgment. Therefore most cases typically settle within the limits of the policy.
